Changes to EUSS

There have been some important changes to the EU Settlement Scheme (EUSS) in the statement of changes to the immigration rules https://www.gov.uk/government/publications/statement-of-changes-to-the-immigration-rules-hc-1496-17-july-2023 including:

  • Pre-settled status – from September 2023 those with pre-settled status will have their status automatically extended by 2 years; The Home Office also intends to take steps to automatically convert some pre-settled status to settled status from 2024 by doing automated checks of pre-settled status holders
  • Late applications – from 9 August applicants will have to provide a proof of a valid reason for the delay before their application is accepted and a COA issued;
  • EUSS will no longer be open for family members of a qualifying British citizen, known as ‘Surinder Singh’ cases or the primary carer of a British citizen, known as ‘Zambrano’ cases.
